Colorado Open Records Act

The Crestone Charter School is committed to being open, accountable, and accessible to the public. CCS's approach to the Colorado Open Records Act (CORA) is an important part of its pledge to transparency to build trust with our community. These guidelines help CCS provide the public with efficient access to documents and records pursuant to the Colorado Revised Statutes, C.R.S. §24-72-205(6). This policy incorporates and subsumes MCSD2 Public's Right to Know Policy.

Making a Records Request

Requesters must submit a paper or email request to the CCS officemanager@crestonecharter.com who is the custodian of school records. A request is considered "received" by CCS the day an e-mail, fax or letter containing a request is opened. CCS shall make every effort to respond with an estimated date for completing the request within three working days, as provided by § 24-72-203(3)(b), C.R.S. CCS may extend its response period up to seven working days if it finds extenuating circumstances exist and communicates that finding to the requestor in writing, as described in § 24-72-203(3)(b), C.R.S. The three working-day response time begins the first working day following receipt of the request.

CORA Costs

To pay for the cost of processing a CORA request, CCS will charge for the time spent and material costs to research, retrieve, and respond to requests for records under CORA in accordance with § § 24-72-205(5)(a) and (6)(a), C.R.S. CCS will provide the requester with a time and cost estimate, which will require a pre-payment before processing the request. If the requestor pays for more time than is spent processing the request, they will receive a refund. After the estimate and pre-payment, CCS will keep the requestor informed if any additional costs are anticipated and will not incur any additional costs without the requestor's prior consent. Costs must be paid in full before CCS provides the records.

  • Staff time may be charged at a rate of up to $33.58 per hour.  

  • There is no charge for the first hour to research and retrieve records.

  • There is a charge of $0.25 per page for regular paper copies, with an additional cost for other paper sizes.

  • Attorney billable hourly rate, or contractor hourly rate, as applicable

Format and fulfillment of the Request

CCS will not be responsible for conducting analysis or manipulation of records on behalf of a requestor. If a records request requires more than mere retrieval of records—such as technical expertise to synthesize or reconfigure data, reformatting of documents (for example to .pdf), redaction for any reason, or legal expertise from attorneys in order to identify how to comply with confidentiality requirements—CCS will charge the requestor for such costs. Any costs charged to a requestor shall not exceed the actual cost of producing the records, in accordance with § 24-72- 205(5)(a), C.R.S.

Confidentiality and Privacy 

CCS will not release identifiable student or personnel documentation except to the person listed on the documents, or their immediate family member.
